Prawne i ekonomiczne aspekty karalności insider tradingu

Abstract

Celem artykułu Cz. Martysza jest omówienie zarówno prawnych, jak i ekono- micznych aspektów insider tradingu oraz próba zakwestionowania zasadności jego

penalizacji. Z uwagi na podejmowane zagadnienia Autor w swoich rozważaniach położył główny nacisk na rodzimy rynek kapitałowy. Przedstawił ewolucję przepisów prawa w aspekcie skuteczności ściągalności insider tradingu. Zaprezentował również rozważania dotyczące próby odpowiedzi na pytanie, dlaczego insider trading jest zabroniony.

Groundless disclosure or use of confidential information and professional secrecy, called insider trading was formally banned in the 20th century. With regard to the overall elimination of this phenomenon as well as a common non-explicitness of its perception, there are discussions on the legitimacy of the ban of insider trading, ignited also by celebrities in the world of economics and finance. The article is aimed at the discussion of the ethical, legal and economic aspects of insider trading in favour of its hypothetical legalisation. The author makes use of the latest achievements of the Polish and foreign literature. He also tries to present these aspects of insider trading which deserve further thorough research.
